Terms of Use for Surf Seller App

These Terms of Use (“Terms”) govern the use of the Surf Seller App (the “App”) by registered sellers (“Users”). By accessing or using the App, you agree to comply with these Terms. If you do not agree with these Terms, you will not be able to use the App.

1. Account Registration and Security

  • New Sellers: To register on the App, you must provide accurate information, including your name, business name, VAT number, and WhatsApp contact number. This information is used to verify your identity as a seller on the Surf platform.
  • Registered Sellers: Existing users may log in using their registered email and password. You are responsible for maintaining the confidentiality of your login credentials.
  • Security: You agree to notify Surf immediately of any unauthorized access or breach of security involving your account.

2. Dashboard Overview

  • Access to Information: Once logged in, Users can view their income, orders, sales, taxes, active products, and out-of-stock products through the dashboard.
  • Filters: Users can apply date filters to analyze their performance over specified periods. All data displayed is intended for informational purposes only and may be subject to further verification by Surf.

3. Product Listing and Management

  • Product Upload: Users may list products by entering general information, categories, pricing, full descriptions, and inventory levels, and by uploading images of each product.
  • Shipping Options: The App provides options for pick-up from store, same-day and next-day delivery, allowing customers to specify available shipping for each product.
  • Listing Fee: A platform fee is added to the final price displayed to customers. This fee structure is as follows:
    1. Products priced between €1 - €20 will incur a fixed fee of €2.99.
    2. Products priced between €20 - €40 will incur a fixed fee of €3.99.
    3. Products priced above €40 will incur a fixed fee of €5.99.
  • Accurate Descriptions: Users are responsible for ensuring that product descriptions, prices, and inventory levels are accurate and up-to-date.

4. Order Management

  • Order Status Updates: When an order is placed, Users are responsible for managing the order status. This includes updating the status as the order is processed and shipped for delivery.
  • Compliance with Shipping Terms: Users agree to adhere to the selected shipping terms by the customer and ensure timely delivery of products to maintain customer satisfaction.

5. Fees and Payments

  • Platform Fees: Surf charges a fixed fee on each product sold, which is incorporated into the listing price. By listing products, Users agree to the fee structure detailed in Section 3 and authorize Surf to deduct the applicable fees from each sale.
  • Taxes: Users are responsible for compliance with all applicable taxes and VAT requirements associated with product listings on the Surf platform.

6. User Responsibilities

  • Compliance with Laws: Users agree to comply with all applicable laws and regulations in relation to the products listed, sales conducted, and data provided.
  • Accurate Information: Users agree to provide accurate and complete information in their account details, product listings, and order processing.
  • Intellectual Property: Users warrant that they own or have the rights to all content, including images and descriptions, uploaded to the App.

7. Return and Refund Policy

Surf is committed to providing a reliable and customer-friendly experience. This Return and Refund Policy outlines the responsibilities of sellers (Users) regarding returns and refunds initiated by customers.

7.1 Seller Responsibility for Returns

Faulty or Incorrect Items: If an item is returned due to issues arising from the seller’s side (e.g., defective product, incorrect item shipped), Surf reserves the right to deduct the cost of the return or exchange from the seller’s earnings. This ensures that customers are compensated fairly for seller-related errors.

Exchange Requests: Customers may choose to exchange products at the seller’s physical store location. However, if a customer requests delivery of an exchanged item, any delivery costs incurred will be deducted from the seller’s earnings.

Adherence to Quality Standards: Sellers are responsible for ensuring product quality and accuracy in descriptions. Repeated issues with returns due to quality or misrepresentation may lead to penalties or account suspension.

7.2 Return and Refund Process

Customer Returns and Pickup: Surf facilitates customer returns through our logistics partners. If the reason for return is due to an issue on the seller’s part (e.g., defective product, incorrect item), the cost associated with the return will be deducted from the seller’s account.

  • Refunds to Customers: Refunds will be issued to customers after the returned item has passed quality checks. Any applicable return or delivery fees, as outlined above, will be deducted from the seller’s account if the fault lies with the seller.
  • Delivery for Exchanges: Customers may exchange items at the seller’s physical store location. However, if the customer requests delivery of the exchanged item, Surf will facilitate delivery, and the delivery charges will be deducted from the seller’s account.

7.3 Non-Returnable Products

  • Certain items, such as perishable goods and personal care products, may not be eligible for returns or exchanges. Sellers must clearly indicate the returnable or non-returnable status of such items in product descriptions.

8. Termination and Account Suspension

  • Surf reserves the right to suspend or terminate any account for violations of these Terms, including but not limited to the submission of inaccurate information, failure to manage orders appropriately, or non-compliance with applicable laws.

9. Limitation of Liability

  • Surf shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use or inability to use the App, including but not limited to losses related to revenue, data, or customer satisfaction.

10. Changes to the Terms of Use

  • Surf reserves the right to update or modify these Terms at any time. Users will be notified of significant changes via email or through notices in the App. Continued use of the App after changes are published constitutes acceptance of the revised Terms.
